Business setup in Dubai from UK for British founders
Business setup in Dubai from UK is open to British citizens with 100% ownership, and UK passport holders can enter the UAE without a visa in advance. A UAE company is a separate legal entity, so it does not move your UK company. A typical free zone first year with one visa is about AED 12,900–30,500.
Typical range AED 6,500–AED 15,000 (free zone licence only, typical market range October 2026)
Facts checked 2026-10-26
Most UK founders asking about Dubai are really asking one of three things: can I run my existing UK business from the UAE, do I need a new UAE company, and what happens to my UK tax position. The first two are company-structure questions; the third is a UK tax question that this site cannot answer for you.
This page sets out what the UAE side requires, which UK rules are worth raising with a UK adviser early, and what a first year typically costs. Prices are typical market ranges for October 2026.
Business setup in Dubai from UK: can I move my UK company?
A UAE company is a separate legal entity, so forming one does not move your UK company. What you do with the UK company, whether to keep it, run it alongside the UAE company, or wind it down, is a UK company-law and tax decision with different consequences for each route. Take advice from a UK accountant or solicitor before you change anything.
On the UAE side, the process is the same as for any foreign owner: choose an activity and licensing authority, register, then complete the residence visa steps. A free zone company can be 100% foreign-owned, and so can most mainland activities since the 2021 Commercial Companies Law changes.
UK tax residence when you move to Dubai
The UK government's Statutory Residence Test decides whether you are UK-resident for tax, and it is based largely on days spent in the UK in a tax year. Spending 183 or more days in the UK is an automatic UK test. Fewer than 16 days (46 if you were not UK-resident in the previous three tax years) is an automatic overseas test. In between, ties such as work, family and accommodation matter. UK residents are generally taxed on worldwide income, and non-residents on UK income.
- Your residence status can change from year to year
- Split-year treatment has its own conditions
- HMRC publishes a residence status checker
Do UK controlled foreign company rules affect a Dubai company?
HMRC's controlled foreign company rules can apply to companies that are not UK-resident but are controlled by UK residents, and a charge can arise on certain profits. Whether they reach a UAE company you own depends on facts such as who controls it, where decisions are made and what the profits are. Ask a UK tax adviser to review this before you register, not after. This is general information, not tax advice.
Entry rules for British citizens setting up in Dubai
The UAE Ministry of Foreign Affairs lists the United Kingdom as visa free. The UK government's travel advice says British citizens receive a visitor visa on arrival free of charge, valid for up to 90 days in any 180-day period, and that the passport must have at least six months' validity. It also warns that working on a visit visa can lead to fines, imprisonment or deportation, so a visit is not a way to start working in the UAE.
Company owners then apply for a residence visa, which needs a medical test for applicants aged 18 and over, a security check and an Emirates ID. A residence visa generally lapses if you live outside the UAE for more than 180 continuous days, with listed exceptions, so factor that in if you will keep a UK base.
Working remotely in Dubai for a UK company
If you work for an employer outside the UAE rather than owning a UAE company, the UAE offers a virtual work visa. The government portal describes it as a one-year visa for people who work for a company outside the UAE, with proof of that work, a salary certificate showing at least USD 3,500 a month or equivalent, health insurance and a medical fitness result. It is a different route from a company-owner residence visa, so choose the one that matches how you will earn.
Legalising UK documents for the UAE
The UAE chain starts with the issuing country's foreign ministry. In the UK, the Legalisation Office checks signatures, stamps or seals against its records and attaches an apostille. The document then goes to the UAE Embassy in London and the UAE Ministry of Foreign Affairs. British embassies in the UAE cannot legalise documents. Ask the licensing authority which documents it needs, because many requirements depend on whether a shareholder is a person or a company.
UK–UAE tax treaty
The UK–UAE double taxation convention entered into force on 25 December 2016 and has been modified by the Multilateral Instrument. A treaty sets out which country may tax which income; it does not replace the residence and CFC analysis above. On the UAE side, corporate tax is 9% on taxable income above AED 375,000, with a 0% rate for income that qualifies in free zones.
Steps to set up a UAE company as a UK-based founder
Take UK tax and legal advice first
Residence, CFC and how the existing UK company is treated come before any UAE registration.
Choose the activity and licensing authority
Free zone or mainland depends on where your customers are and whether you need an office.
Legalise the UK documents that are required
Legalisation Office, then the UAE Embassy in London, then UAE MoFA.
Register and receive the licence
Many authorities allow digital signatures and emailed licences.
Travel for the residence visa steps
Medical test, biometrics and Emirates ID, then plan your UK day count.
Register for corporate tax and open a bank account
Corporate tax registration support typically costs AED 500–1,500.
Typical documents for a UK shareholder
- Valid UK passport copy and passport-size photo
- Proof of UK address if the authority asks for it
- Legalised UK company documents where a UK company will hold the shares
- Legalised power of attorney if someone signs for you
- Business plan and source-of-funds evidence for the bank
Things to weigh up
- UK tax residence and CFC questions are for a UK adviser; the UAE licence does not answer them.
- A visit is not permission to work. Keep the entry visa and the residence visa separate in your plans.
- Spending long periods outside the UAE can affect residence, as well as how many days you spend in the UK.
Common questions
Can I move my UK company to Dubai?
Forming a UAE company does not move a UK company, because they are separate legal entities. Whether to keep, run alongside or close the UK company is a UK legal and tax decision, so take UK advice first.
How do I set up a company in Dubai from the UK?
Choose an activity and licensing authority, legalise any documents they require, register, then travel for the residence visa medical test and Emirates ID. Registration can often be done online; the visa steps need a visit.
Do British citizens need a visa for Dubai?
The UAE lists the UK as visa free. The UK government says a visitor visa is issued free on arrival, valid up to 90 days in 180, with a passport valid for six months. Working on a visit visa is not allowed.
Can I work remotely in Dubai for a UK company?
The UAE has a one-year virtual work visa for people who work for a company outside the UAE, with a salary certificate showing at least USD 3,500 a month. It is separate from owning a UAE company.
Do UK tax rules still apply if I own a UAE company?
They can. UK residents are generally taxed on worldwide income, and HMRC's controlled foreign company rules can apply to non-UK companies controlled by UK residents. Ask a UK tax adviser. This is general information, not tax advice.
